Terms of Service

1. What Clawmark Is
Clawmark provides AI-powered marketing and operations agent teams for small businesses. When you subscribe, you get a dedicated team of AI agents that create content, monitor reviews, track performance, and help grow your business.
2. Your Account
- You must be at least 18 years old and authorized to act on behalf of the business you register
- You are responsible for keeping your account credentials secure
- One account per business (multiple properties can be added to the same account)
- You must provide accurate business information during onboarding
3. Subscription & Billing
- Standard plan: $199/month, billed monthly
- Additional properties: +$99/month each
- Extra capacity: available in $20 increments if you exceed your weekly usage allocation
- Payment is processed by Stripe. You agree to Stripe's terms of service
- Your subscription begins when payment is confirmed
- Billing occurs on the same day each month
4. Satisfaction Guarantee
If you're not satisfied within the first 14 days, contact us for a full refund. No questions asked. Email hello@getclawmark.com.
5. Cancellation
- Cancel anytime — no long-term contracts
- When you cancel, your agents will continue running until the end of the current billing period
- After cancellation, you have 30 days to export your content and data
- After the 30-day grace period, your VPS and data will be permanently deleted
6. What Your Agents Do (and Don't Do)
Your agents will:
- Create content drafts for your review and approval
- Monitor and draft responses to reviews
- Track performance metrics and provide insights
- Discover local events and growth opportunities
- Run Instagram engagement sessions
Your agents will NOT:
- Publish content without your explicit approval (in the default mode)
- Make pricing or business decisions on your behalf
- Respond to customers or guests without your review
- Access data you haven't authorized via connected integrations
7. Content Ownership
- Content created by your agents belongs to you
- You are responsible for reviewing and approving all content before publication
- Clawmark does not claim ownership of your content, photos, brand assets, or business data
8. Content Compliance
You are responsible for ensuring published content complies with applicable laws, including:
- FTC disclosure requirements for sponsored content
- Local advertising regulations
- Platform-specific terms of service (Instagram, Google, Yelp, etc.)
- Copyright and trademark laws
Your agents follow best-practice guardrails, but Clawmark does not guarantee legal compliance of generated content.
9. Connected Services
When you connect third-party services (Instagram, Google, Yelp, etc.):
- You authorize Clawmark to access and use those services on your behalf
- You are responsible for maintaining valid connections (re-authorizing when tokens expire)
- Clawmark is not responsible for changes to third-party API terms or availability
10. Service Availability
- We aim for high availability but do not guarantee 100% uptime
- Scheduled maintenance will be communicated in advance via your orchestrator
- We are not liable for downtime caused by third-party services (Anthropic, DigitalOcean, Instagram, etc.)
11. Usage Limits
Each account has a weekly AI usage budget ($40/week). If you approach the limit:
- At 80%: your agents automatically optimize to use more efficient models
- At 100%: you can purchase additional capacity in $20 increments
- Typical usage is well below the limit — most customers never hit it
12. Acceptable Use
You agree not to use Clawmark to:
- Generate spam, misleading content, or fake reviews
- Violate platform terms of service (Instagram, Google, etc.)
- Harass, defame, or impersonate others
- Engage in illegal activities
- Attempt to reverse-engineer, exploit, or disrupt the service
13. Limitation of Liability
Clawmark is provided "as is." To the maximum extent permitted by law, Clawmark shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or revenue, resulting from your use of the service.
14. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or through your orchestrator at least 30 days before taking effect.
